1. Who we are
Hydro Wind Energy, Inc. ("HWE", "we", "us", "our") operates the website at hw.energy and provides the technology and information services described on it. Our US office is at 355 Bryant Street, Suite 403, San Francisco, CA 94107. Our UK office is at 86–90 Paul Street, London EC2A 4NE, United Kingdom. For privacy enquiries, contact [email protected].
2. What we collect
We collect a small amount of information, deliberately. The categories are:
- Contact information you give us via the website form: name, email, organisation, enquiry type, and the body of your message.
- Reg A+ sign-up information if you opt in to be notified about a community round: name, email, and optionally country of residence.
- Technical information automatically logged by our hosting infrastructure: IP address, user-agent string, referrer, and the pages you visit.
- Analytics information from privacy-respecting analytics that count visits in aggregate. We do not use third-party advertising or social-media tracking pixels.
3. How we use it
We use this information to respond to your enquiry, to operate and secure the site, to comply with legal obligations (including securities law for Reg A+ communications), and to understand which content is useful. We do not sell your personal information. We do not share it with advertising networks.
4. Legal bases (UK / EEA)
For visitors in the UK and EEA, the legal bases we rely on under UK GDPR / GDPR are:
- Consent for non-essential cookies and Reg A+ marketing communications.
- Legitimate interests for responding to enquiries, operating the website, and aggregate analytics.
- Legal obligation for records we are required to keep under securities, tax, or company law.
5. Retention
Enquiry records are retained for 24 months from the last interaction. Reg A+ sign-ups are retained until you unsubscribe. Server logs are retained for 30 days. Records we are legally required to keep are retained for the statutory period.
6. Your rights
Depending on where you live, you have rights to access, correct, delete, export, or restrict processing of your personal information, and to object to processing. UK and EEA residents have the right to complain to a supervisory authority (in the UK, the Information Commissioner's Office at ico.org.uk). California residents have rights under the CCPA / CPRA, including the right to know, delete, correct, and opt out of "sales" or "sharing" of personal information — though we do not sell or share personal information as those terms are defined under California law.

7. International transfers
We operate from offices in the US, UK, UAE, Oman, and China, and our service providers may process information in additional jurisdictions. Where we transfer information from the UK or EEA, we rely on adequacy decisions where they exist or on the UK International Data Transfer Addendum and EU Standard Contractual Clauses where they do not.
8. Security
We use industry-standard administrative, technical, and organisational measures to protect personal information. No system is perfectly secure; if you believe an account or message of yours has been compromised, please contact us immediately.
9. Changes
We may update this policy from time to time. The "Last updated" date at the top of this section reflects the most recent revision. Material changes will be flagged on the site for at least 30 days.

2. The site is informational
The website provides information about HWE's technology, products, team, and capital formation activities. Nothing on it constitutes an offer to sell, or a solicitation of an offer to buy, any security. To the maximum extent permitted by law, HWE will not be liable for indirect, incidental, consequential, or punitive damages arising from your use of the site, even if advised of the possibility. Our aggregate liability for any claim related to the site will not exceed US$100.

9. Governing law & venue
These Terms are governed by the laws of the State of California, USA, without regard to its conflict-of-laws principles. Disputes will be brought exclusively in the state or federal courts located in San Francisco County, California.

Real-world capacity factors will vary with site conditions, regulatory environment, and operating profile.

Targets such as <$13–$40 per MWh for OceanHydro Omni and <$0.10 per cubic metre for SubSea RO Wind are aspirational targets at commercial scale, not delivered prices. Pilot unit economics will differ.
